Implementation Note

This document is for Discover publishing, monetization, revenue share, payouts, third-party payments and KYC/KYB. Publishing and monetization should require separate acceptance; monetization should require renewed acceptance and third-party KYC/KYB flow.

Scope and Developer Status

These terms apply to all actions by which you publish, display, distribute, sell, subscribe, accept tips, charge fees, participate in revenue share or receive payouts for apps, templates, projects, services, components, pages, code, APIs, AI tools, automation workflows or other content on PocketBay Discover.

As a developer, publisher, seller, service provider or payee, you are solely responsible for your listing, app, content, features, pricing, user promises, end-user support, privacy compliance, refund statements, intellectual property, taxes, licenses and applicable law. PocketBay provides platform, hosting, distribution, review, payment integration or payout assistance functionality and does not become your employer, agent, partner, co-seller or guarantor unless a separate written agreement says so.

Before publishing to Discover or enabling monetization, you must separately accept these terms. Acceptance of the ordinary Terms during registration does not grant you any right to publish, charge, receive payouts, receive promotion or remain listed.

Publishing, Review, Removal and Exposure

PocketBay may decide at its discretion whether a listing may be published, displayed, searched, recommended, ranked, monetized or kept live. PocketBay may review, reject, require modification, hide, demote, remove, suspend, delete or terminate any listing, app, monetization capability, payout capability or related resources without guaranteeing prior notice.

PocketBay does not guarantee approval, ranking, exposure, traffic, revenue, conversion, continued listing, continued availability or compatibility for any listing. Discover search, recommendation, ranking, tags, categories, homepage placement, promotions and experiments may be changed at any time.

You must not use misleading titles, fake screenshots, traffic manipulation, fake reviews, incentivized reviews, keyword stuffing, official impersonation, hidden fees, implied PocketBay endorsement, copied listings, trademark infringement or any method to manipulate the Discover ecosystem.

Monetization, Platform Fees, Percentages, Quotas and Sellable Service Changes

PocketBay may allow or restrict one-time purchases, subscriptions, tips, template sales, paid deployment, premium services, usage-based charges, revenue share, coupons, free trials, enterprise quotes or other monetization models. PocketBay may decide which developers, territories, currencies, service types, categories, price ranges, billing cycles, quantities, quotas, plans, features, APIs, resources, templates or projects may be sold or monetized.

PocketBay may adjust platform service fees, commissions, revenue-share percentages, payout cycles, minimum payout amounts, reserve percentages, refund/chargeback deductions, fee allocation, tax handling, currency conversion, sellable quantities, sellable territories, price floors/ceilings, promotion rules, subscription rules, trial rules, cancellation rules, overage charges, free allowances, paid service types and monetization eligibility at any time. Unless required by law or expressly committed in writing by PocketBay, such changes do not create any obligation to compensate, maintain legacy percentages or continue monetization capabilities.

You must not circumvent PocketBay fees, revenue share, payments, KYC/KYB, refunds, chargebacks, risk control or review processes, including by directing users to offline payments, bypassing subscriptions externally, hiding revenue, splitting orders, fake refunds, fictitious transactions, related-account self-dealing or rule circumvention.

Third-Party Payments, Wise/Stripe, KYC/KYB and Payouts

PocketBay payments, collections, KYC/KYB, identity verification, sanctions screening, AML review, tax-information collection, payment processing, refunds, chargebacks, holds, reserves, delayed payouts, payout refusals or account restrictions may be handled by Wise, Stripe, payment institutions, banks, acquirers, tax-service providers or other third-party providers under their independent terms, policies, risk controls and legal obligations.

You must provide true, accurate, complete, current and authorized information and complete individual or business KYC/KYB, beneficial owner, director, address, tax, bank-account, business-nature, transaction-purpose, sanctions/PEP/AML and other verification requirements as required by third-party providers. PocketBay does not guarantee that you will pass verification, remain eligible to receive payouts, receive funds in any territory or currency, receive funds at any expected time or earn any specific revenue.

PocketBay may delay, freeze, offset, reverse, withhold, refuse or cancel any payout based on payment-provider, bank, upstream-provider, regulatory, tax, sanctions, AML, risk, chargeback, complaint, fraud, refund, negative-balance, violation or platform-policy reasons, and may require you to repay settled funds or bear related fees, penalties, charges, taxes and losses.

Developer Obligations, End-User Support and Refunds

You must provide accurate, complete, current and non-misleading listing information, including name, description, features, limits, price, subscription period, refund statement, support method, privacy policy, license terms, dependent services, third-party fees, data processing and risk disclosures. Paid listings must provide a reachable support method, by default your developer contact email or a channel specified by PocketBay.

Unless PocketBay expressly states otherwise as merchant of record or platform refund handler, you are primarily responsible for feature delivery, customer support, updates, maintenance, defect fixes, compatibility, complaints, refunds, cancellations, consumer rights, taxes, invoices, licensing and after-sales obligations to end users. PocketBay may process refunds, cancellations, suspensions or deductions for platform-policy, consumer-protection, payment-provider, chargeback, complaint, fraud or compliance reasons, but this does not assume your developer responsibilities.

If refunds, chargebacks, disputes, fraud, violations, penalties, taxes, negative balances or third-party claims occur, PocketBay may deduct, offset, reserve or recover amounts from any funds payable to you.

Data, Privacy and End-User Terms

If your app collects, generates, stores, processes, publishes, sells, shares or transfers personal information, sensitive information, payment information, health information, children's data, logs, analytics data or end-user data, you must provide your own lawful, clear and accessible privacy policy, user terms, data-processing disclosures, unsubscribe/delete/access mechanisms and required consents, and comply with applicable law.

You must not treat PocketBay's Privacy Policy as your app's privacy policy. PocketBay's Privacy Policy explains how PocketBay processes platform data and does not replace the developer's notices, consents, data-rights responses, cross-border transfer requirements, retention/deletion rules, security safeguards or regulatory obligations to the developer's end users.

PocketBay may require you to submit a privacy policy, user terms, DPA, license, open-source inventory, security statement, data-flow diagram, compliance evidence or other materials. If you refuse, delay, submit inadequate materials or pose risk, PocketBay may reject, remove, suspend monetization or terminate the listing.

Intellectual Property, Licenses and Infringement Complaints

You warrant that you own or have obtained all rights necessary to publish, display, sell, license, distribute, host, run and authorize PocketBay to process your listing, app, code, assets, images, trademarks, models, data, documentation and related content. You must comply with open-source licenses, third-party API terms, model policies, asset licenses, trademark rules and industry practices.

You must not publish content that infringes copyright, trademark, patent, trade secret, publicity rights, privacy rights, data rights, contractual rights or other rights. Upon receiving infringement complaints, DMCA or similar notices, trademark complaints, security complaints, privacy complaints or regulatory/law-enforcement requests, PocketBay may hide, remove, restrict, delete, preserve evidence or disclose necessary information without prior notice.

If your listing is complained about, removed or disputed, you must handle claims from rightsholders, end users, payment institutions, regulators and third parties and indemnify PocketBay for related losses.

Prohibited Conduct and High-Risk Content

Discover listings must not include or facilitate unlawful activity, infringement, fraud, phishing, malware, security bypass, account theft, spam, traffic manipulation, mining, proxies/VPNs/tunnels, illegal adult content, child sexual exploitation, hate or harassment, terrorism, violent extremism, weapons, restricted drugs, gambling, financial fraud, false investment, unlawful medical activity, sensitive-data abuse or any content prohibited by the Acceptable Use Policy.

PocketBay may impose additional review, restrictions, deposits, evidence requirements or prohibitions on high-risk listings such as AI agents, automation tools, user-generated-content platforms, payment/finance, medical, education, children, employment, housing, credit, insurance, legal, government, identity verification, scraping, bulk communications, security testing, data collection or model training.

You must not imply that PocketBay review means safety, legality, official certification, risk-free status or production suitability. Any PocketBay badge, label, ranking or placement is not a warranty.

Indemnity, Liability Limitation and Termination

You agree to indemnify and hold harmless PocketBay and its affiliates, personnel, suppliers, payment providers, KYC providers and upstream providers from claims, losses, costs, penalties and attorneys' fees arising from your listing, app, monetization, payouts, refunds, chargebacks, taxes, privacy, intellectual property, end users, third-party services, unlawful conduct, security incidents or breach of these terms.

To the maximum extent permitted by law, PocketBay is not responsible for Discover listing exposure, traffic, sales, revenue, review, ranking, availability, third-party payments, KYC/KYB, payouts, refunds, chargebacks, end-user conduct, developer conduct, third-party app quality or third-party app security.

PocketBay may terminate your Discover privileges, monetization privileges, payout privileges or developer account at any time. After termination, PocketBay may retain necessary records for billing, tax, payment, dispute, compliance, audit, risk-control and legal purposes, and may hold, offset or recover funds to handle refunds, chargebacks, negative balances, claims or risks.
