Implementation Note
These terms apply when a user creates an independently running licensed copy from a Discover product page. The user must affirmatively accept before creation, and the platform should record the terms version, acceptance time, user, and source product.
Nature of a Licensed Copy
A Licensed Copy is an independently running application instance created from a specified Discover app and operated in your PocketBay space. It is a limited, revocable, non-transferable and non-sublicensable license to use, not a sale or transfer of source code, copyright, trademark, patent, trade secret, application ownership or other intellectual-property rights.
Unless the product page or a separate written agreement expressly states otherwise, a Licensed Copy does not provide source code, build files, creator environment variables, secrets, internal configuration, modification rights, reverse-engineering rights, resale rights or sublicensing rights.
Eligibility, Version and Fees
Eligible signed-in users of free apps, and users with a completed purchase or active subscription entitlement, may create a Licensed Copy when the product permits it. As a general rule, each user may create only one Licensed Copy from the same source app. Creating the copy itself has no additional charge, but the copy user is responsible for compute, storage, network, AI, database and third-party service charges generated by its operation.
A Licensed Copy is normally pinned to the available release version at creation. Any later upgrade, migration or compatibility support depends on the functionality and notices then provided by PocketBay and the creator.
Private Use and Prohibited Conduct
A Licensed Copy is private by default and is for use within your own PocketBay space. You may not publish it to Discover, copy it again, sell, rent, transfer, distribute, make it publicly available, white-label it or offer it as a template, and you may not bypass product access controls, copy protection, billing, quotas, technical restrictions or security measures.
You may not attempt to obtain creator source code, environment variables, secrets, internal APIs or non-public materials, and may not reverse engineer, decompile, disassemble, scrape or otherwise attempt to reconstruct the implementation, except where applicable law expressly prohibits such restrictions.
Data, Operation and Third-Party Services
A Licensed Copy uses your own database, settings and runtime environment. You are responsible for data entered into the copy, accounts, configuration, connected third-party services, end-user conduct, resource use, charges, backups, security and compliance. Source-project data, credentials and private configuration belonging to the creator are not part of the Licensed Copy and must not be disclosed to the copy user.
The app may depend on APIs, models, content, data sources or services controlled by the creator or third parties. Their availability, pricing, limits and terms may change, and PocketBay does not guarantee continuing availability or compatibility.
Availability, Support and Termination
Licensed Copies are provided "as is" and "as available." Unless separately promised in writing, PocketBay and the creator do not guarantee continuous operation, error-free or vulnerability-free service, fitness for a particular purpose, or continuing updates and support. PocketBay may restrict, suspend or terminate a copy for security, illegality, infringement, non-payment, abuse, removal of the source product, account termination or third-party service interruption.
If a copy is terminated, you remain responsible for charges and obligations incurred before termination. The scope and period of any data export depend on the functionality then available and other applicable terms.
Other Applicable Terms
These terms supplement the PocketBay Terms of Service, Acceptable Use Policy, Privacy Policy, Discover Buyer and End User Terms, and applicable product notices. If they conflict, these terms control matters concerning the nature, license scope and prohibited uses of Licensed Copies; the relevant platform terms continue to govern other matters.
PocketBay may update these terms for legal, compliance, security or product changes. Material changes may require renewed acceptance. The terms version recorded when you create a Licensed Copy identifies the version applicable to that authorization.
